Am I Eligible for Gratuity After 4 Years, 7 Months, and 8 Days of Service? Seeking Advice

somu-dada
Hello sir, this posting is with regard to the eligibility of gratuity. In my case, I have completed four (4) years, seven (7) months, and eight days including my last working day. Our gratuity fund is handled by LIC. Can you please let me know whether I shall be entitled to the gratuity as per the rule? If not, is there any way to claim or request from my company?

Awaiting your advice on the above.

Regards, Sdc

You are not eligible for gratuity as you have not completed five years of service. Gratuity for less than 5 years can be payable only when a judgment is passed by the labor court for the claimant.

You are falling short of the eligibility period, even if you reckon on the basis of 240 days of continuous service for the 5th year.
