Registration under BOCW Act by Principal Employer - where none of the building workers are engaged by them

Hi,

As per the provisions of the BOCW Act, it applies to every establishment that employs or has employed, on any day of the preceding twelve months, ten or more building workers in any building or other construction work. Every employer shall register within 60 days of commencing work.

I request confirmation on whether it is mandatory for a principal employer to register under the Act, even if none of the building workers are engaged by them. Your suggestions are appreciated.

The registration is to be done by the employer (in this case, contractor) not the owner of the factory where the manufacturing is done. However, the factory has to pay the cess.

Yes, BOCW registration will be done by the principal employer. In this act, a beneficiary card is very important for those who are working in construction activities. Workers will get the cards from the concerned state government.

If any death or amputation occurs, the government will provide better assistance to them.
