As pointed out by Umakanthan Sir, for applicability of Workmen's/ Employees Compensation Act, wages is not a criterion. But in respect of an employee who is covered by ESI Act the compensation payable as per the Employees Compensation act will be met by the Corporation. Obviously, an employee of an establishment covered by ESI Act whose salary is less than Rs 21000, would be under ESI and hence if any thing happens to him, the ESI Corporation will meet the compensation payable and the employer need not pay it out of his working capital.
