Factory License Dilemma: Should We Count Office Staff as Workers?

We have a factory with around 80 workers, including both shifts. In addition, there is an attached engineering and administration office with a team of around 120 staff, which includes engineers, managers, and administrative staff.

My question is, should we declare the worker count as 80 or 200 when applying for a factory license?

Dear Colleague,

As far as the provisions of the Factories Act 1948, section 2(l), "worker" means a person [employed, directly or by or through any agency (including a contractor) with or without the knowledge of the principal employer, whether for remuneration or not], in any manufacturing process, or in cleaning any part of the machinery or premises used for a manufacturing process, or in any other kind of work incidental to, or connected with, the manufacturing process, or the subject of the manufacturing process [but does not include any member of the armed forces of the Union].

If you read the definition, it is a very broad one in nature as you understand that "ANY PERSON." This includes workers in the normal understanding, staff, supervisors, managers, and so on. Hence, you need to show the total number in the application.
