Confused About PL Encashment? What Does "Full Tenure" Really Mean in Your Offer Letter?

lyston-fernandes
My CTC offer letter states this clause: encashment of accumulated PL (maximum 240 days) on completion of full tenure.

The question is: what is full tenure?

The company has not mentioned the full tenure term. Now the company is saying full tenure is retirement, and we can't pay for resigned employees. Please help with what legal action can be taken.

Understanding Full Tenure and Leave Encashment

Full tenure would mean until the age of retirement. However, that does not mean that in cases of resignation, encashment of accumulated Privilege Leave is disallowed. An employee resigning is entitled to the encashment of leave credits within two days of separation. Are you working in a factory or office establishment? Please clarify so that we can provide you with more guidance.

Please note that under the relevant provisions, only 30 days of EL or PL can be carried forward at the end of the calendar year. As such, you are eligible for encashment for a maximum of 30 days plus leave earned during the current ongoing year, subject to credit in your account.
