Can HR Terminate a JCB Driver with an LMV License After Loader Operation Closure Without Notice?

If an employee working as a driver on a JCB with an LMV license and the loader operation closed 6 months ago without any notice to the labor union and labor department, can HR terminate the employee from the job?

Notice of the termination order does not have to be given to the union or labor department unless the driver is a protected workman as per the ID Act 1947.
