Staff died outside plant under the influence of alcohol - Will his wife get ESIC compensation?

Hlo everyone,

One of our staff has died today due to an accident out side plant.He was also under influence of alcohol.He is cover under PF and ESIC.

Will his wife get ESIC compensation?.and what other benefit can he get. Please share .

Dependent benefit under the ESI Act 1948 is payable for an employment injury sustained as an employee as per the Act. {Section 46(4)}Give more details like whether he was required to be present at the accident site as an employee, was he discharging some duty when the accident happened or it was incidental to the work the deceased was doing etc.
The PF benefits like EPS payment, EDLI amount, PF accumulation are payable. Similarly if there is Labour Welfare Fund contribution then the benefits thereunder would be applicable. It is not making any difference whether the deceased was under the influence of alcohol or the death took place outside the plant for these benefits.
