Confused About Notice Period After Resigning During Probation – What Should I Do?

Hi Cite HR, I have a small query regarding the relieving process. I was under my probation period, which was supposed to end on 19th December 2021. I resigned on 17th December 2021 via email and received an immediate notification on the workday portal stating my Last Working Day (LWD) as 17th January 2022.

Two hours later on the same day, I received my probation confirmation on the portal, extending it for another 5 months and 28 days. I need clarification on whether my notice period will still be 30 days, as per my official resignation mail, or if I will have to serve 90 days.

Resignation through email is considered official. You have resigned while still on probation, and the Last Working Day (LWD) offered to you was 17th Jan 22, which will be considered. The confirmation of your probation was completed later, by which time you were already in your notice period.

Please confirm with your HR partner regarding this situation. They may offer clarity on the matter.

Thank you for the response. I have reached out to my HR partner and People Project Manager regarding this issue. They mentioned that in the system called Workday, it shows that I resigned after completing the probation period. Without acknowledging my email, they bluntly stated that I need to serve 90 days. Could you please guide me on the steps I need to take to obtain a relieving letter?

Dear Varun,

I hope all of these are managed through a full-fledged Payroll system (Workday). However, your probation confirmation must have been initiated by the HR partner post-confirmation from your project manager.

They are not recognizing your resignation letter, but that doesn't mean they can deny any employee's right to resign.

Share all your communication through email chronologically to HR. Since the probation confirmation was received later, they cannot force you to serve the notice period.

However, check your initial appointment order thoroughly for the dates. If the order clearly states that your probation period ends by 19th December, you are at no fault.

Without the acceptance of resignation and a proper notice period, the employer will not issue a relieving order. So, get this sorted out at the earliest.
