Stuck in an Employment Bond: Can I Resign After Completing My 3-Month Term?

sachin-pawar1
Hi all, I have entered into an employment bond with my current employer, which states that I will be employed with the company for a minimum of 3 months. I am about to complete those 3 months in 4 days, and now when I try to resign, HR says I cannot do so as I would be breaching the bond.

Additionally, I am required to serve a 2-month notice period upon resignation, which means I will serve a total of 5 months. However, HR insists that I cannot resign before completing the initial 3 months.

Please help.

First of all, the notice period and bond period run concurrently; it is not one after the other. The general principle is that the bond period starts from the date of its commencement and not from the date of resignation. At any rate, if the bond period is ending in the next 4 days, then all you are left with is only the notice period of two months and nothing more. For any other interpretation, we will have to refer to the bond agreement you have executed or the company guidelines in this regard.
