Dear Colleague,

There is not legal provision prohibiting employee initiating "exit on a leave or holiday". It purely to be looked from administrative angle not on legal angle as there is no such prohibition in any law. If there is a specific mention in your Standing order or Service Rules then you can check for that. In the absence of this you may only insist on serving notice period and you can not deny such initiation. You may demand that the employee hand overs the company properties/assets and hand over the charges to the person assigned etc.

Normally the practice is, one will be treated legally 'exit' only after his/her resignation submitted, is accepted and is relieved after completing all formalities, including Notice Period. As such unless a serving employee reports back after completion of leave/duty off how he/she can complete the legal 'handing over' & Relieving mechanism? This can happen only in exceptional cases like terminally ill, accident and incapacity thereafter, medically unfit etc.
