Hello! I have recently been offered a job position as a content writer in a gemstones company. However, due to minimal contact with gems in the role, I have been asked to submit three blank cheques on the joining date as a precautionary measure. Is it appropriate for the employer to make such a request?

It is not lawful to demand a "Blank Cheque" from anyone. Never give such a cheque, as it may come back to haunt you at any time. This is not a sound practice; therefore, avoid it and instead, seek out better offers.

I wonder what the meaning of the demand is anyway. It seems unreasonable because, legally, it cannot be enforced. The employee just needs to issue a stop-payment order immediately and remain calm. Even if there is a reason and the employer deposits the cheque later, it will not clear. Alternatively, the employee might provide a blank cheque from a different bank where they have no funds.

Legal Implications of Issuing Blank Cheques

In case they consider filing a Section 138 case, the existence of a dispute and absence of a real debt will likely result in the case being dismissed. Furthermore, if the employee files an FIR stating the cheque is stolen, the criminal liability may fall on the company.
