Appointment Letter after 9 months of Date of Joining & Forcing to work for 2 years minimum without Written Contract.

Dear Team,

Three Years before I was working with as an Host Country National (HCN) in Liaision office and after 3 years it got merged with another India Pvt Limited company. During the merging, I have resigned & negotiated for Salary Hike where they promised to get Salary Hike/Promotion after 3 years. After formal Resignation from the Previous employer & New Merged Employer gave Good Salary Hike with Lower Grade Position.

I have accepted the Offer Letter in April 2021 with Proper monthly Payslips, PF deductions .

HR team said that they will issue formal Appointment Letter after 1 month. So many followups with HR, I didn't receive response from them after 9 months of Date of Joining & request them for Appointment Letter by email and also Whats-app Chat/ One to One Meeting with HR.

At last, I have resigned formally and given 3 months Notice period as per HR Policy shared by email.

Immediately I got an email reply from HR that "As per Appointment letter Clauses that the Employee has to work at least for 2 years" because you have taken salary hike with special case approval. But I didn't have got without terms contract agreement & terms & conditions so far.

I am really worried about the Exit Process in the current company to switch over to New Job role.

1. Whether I can accept Formal Appointment Letter after resignation and serving Notice period right now?

2. How to approach for the Relieving Letter/ Service letter from HR for smooth exit from the company.?
