Facing Termination and Withheld Salary: How Should I Handle This Unfair Situation?

Hi, I am working as an Assistant ASM with one of the companies. My manager is asking me to resign or he will terminate me, stating that he is not satisfied with my market working performance. I joined on the 15th of June. SS had a closing stock of 40 lakh, and sales averaged between 1.5 to 2 lakh. During June-November 2020, sales were 1,700,000, and June-November 2021 sales were 3,300,000. There is secondary growth and a primary growth of 62% over the last year.

They have withheld my salary, and expenses have not been cleared from June to date. Now the manager is saying my average market working hours are 3 hours, while the company's expectation is 7 hours. If he was unsatisfied, he could have informed me earlier. But holding the salary and expenses, he is now sharing this story. I am dependent on my salary, and my father needs to undergo angioplasty, requiring 2 lakh for it. I request the clearance of my pending dues. If you are not satisfied, I am willing to resign, but please clear my salary and expenses.

Kindly suggest how to handle this situation.

In sales jobs, this is the practical challenge many talents undergo as the market is tough, targets are high, and support from managers will be less because everyone will be chasing numbers. It is not the mistake of your manager, who will have similar pressure like you and more than you in many instances. As your hard-earned money is locked, try to work as per the instructions of your manager, maybe for 7.5 hours on average, and get your money released first. Then seriously try out and go for any other good job offer within the shortest time possible.

If you initiate legal action, it will take years and years further. Hence, have a cordial work relationship and aim to get back your money first, then decide to leave if you are still unable to adjust with the given work profile.

At the end of the day, you should not be the loser; you should be clear in a win-win for both sides and do not be a loser of your hard-earned money.
