Feeling Misaligned in My New IT Role: Can I Resign Without a Notice Period During Probation?

Hi all, I joined an IT company in August, and due to improper role alignment, I am not able to fit into the role. I want to resign now. I have been working in this company for 2 months now and am on a probation period. Can the company hold me for a notice period during the probation period? My Offer Letter States this:

Probation/Confirmation

You will be on a probation period for 3 months. Based on your performance, your services will be confirmed with the company in writing after 3 months. After confirmation, your notice period will be for 3 months on either side.

Can they force me for a notice period without any clause during the probation time? Urgent help needed?

As per the employment contract you have with the company, they cannot demand any notice period, but you can leave after submitting your resignation. Please let me know if you need any further assistance.

As per the information provided in this post, your employer cannot force you to serve the notice period. You should send a communication quoting the clause that states you are not bound by the notice period as the services are yet to be confirmed.

Generally, the notice period during the probationary period is shorter than that during confirmed employment or the same. However, since your company seems to have forgotten to take this difference into account in the offer letter, you can use it. Except that the individuals who would come or join after you may find this disparity corrected with some notice period clearly defined during probation as well. However, I suggest making your exit as smooth as possible.
