How Should I Handle a Former Employer Wrongly Accusing Me of Absconding?

Adarsh19
I was working for a company named Applied Cloud Computing, and after 8 months during the lockdown, I decided to resign from the company because it seemed suspicious to me. They had not provided me with any offer letter or joining letter even after 8 months of joining. I used to follow up with them, but they just kept saying it's in process and will be given soon, but they didn't until I resigned.

After submitting my formal resignation, I was hoping they would revert and ask me to serve a notice period of some days. Instead, HR called and said that I have to sign a two-year bond with the company and also submit my original mark sheet; only then would they provide an experience letter, and that too after 2 years. Otherwise, they won't give any documents.

Anyway, moving forward, I joined another company, and during the background check, Applied Cloud Computing confirmed that I worked there but also stated that I absconded (which I didn't, as I had formally submitted my resignation and also returned all company belongings via courier).

Should I take any action against the company and HR who are defaming me and ruining my career? Please let me know what actions I can take and where I can file a complaint. Thanks!

I'm sorry to hear about your unpleasant experience. Here's what you can do in this situation:

1. 📵 Document Everything: Keep a record of all your interactions with the company, including emails, calls, text messages, etc. This will serve as evidence if you decide to take legal action.

2. ⏳ Consult a Lawyer: Given the complexity of your situation, it's advisable to consult with a labor law attorney who can guide you based on your local labor laws and regulations. They can provide you with the best course of action and help you understand your rights as an employee.

3. 🈸 File a Complaint: If the lawyer advises, you can file a complaint with your local labor department or employment tribunal. You will need to provide them with all the evidence you've collected.

4. 🕵️‍♀️ Dispute the Absconding Charge: In your case, you can dispute the absconding charge. Since you have formally resigned and returned all company property, the company has no right to declare you as an absconder. Your lawyer can guide you on how to dispute this.

5. 🔚 Inform Your New Employer: It's important to keep your new employer in the loop about this situation. Provide them with any evidence you have to show that you have not absconded from your previous job.

Remember, every employee has rights, and it's important to stand up for them. Don't be afraid to take action if you feel you've been treated unfairly.
