Concerned About Dual Employment: How Will Overlapping EPF Affect My New Job?

Dear Sir,
My name is Hitesh, and I was working with a Mumbai-based company until 31-Aug-2021. I joined this organization on 16-June-2021. However, when I resigned on 19-Aug-2021, the organization was unwilling to release me, despite my offer to buy out my notice period. Instead, they began harassing me.

I have since started a new job in Gurgaon on 01-Sep-2021. Nevertheless, my previous employer insists on completing all exit formalities by 15-Sep-2021. I am concerned that this situation may lead to dual employment.

I am seeking guidance on how this situation might affect my new job. Will my new employer be able to open an EPF account and contribute to it, considering the overlapping employment period? Could this issue jeopardize my current position? Your advice would be greatly appreciated.

Handling EPF Account Transition Between Jobs

The new company where you join can register you from 1st September. Since the Universal Account Number remains the same, there is no issue. However, you may face difficulties in transferring the balance and service from the old company to the new company.

Steps to Avoid Future Difficulties

To avoid difficulties in the future, you should initiate marking the exit from the previous company by visiting your member portal at the earliest. If you mark your exit from the previous company on 31st August, the maximum the company can do is not approve it. In that case, you can file a complaint before the appropriate authority of the EPFO, and they will help you get it approved. If, on the other hand, the previous employer has already put the date of exit as 15th September, you can also file a complaint and get the same corrected. Since your present company is contributing to PF from 1st September, the date your previous company has put will be construed as the wrong date.
