How to Handle a Resignation When Your Company Demands a 3-Month Notice Period?

Hi team, I joined a company 3 months ago and was on probation for a period of 6 months. However, the work culture and shifts were taking a toll on me, and I started falling sick quite often. Due to my health reasons, I had to resign at the earliest. I have sent my letter of resignation to the employer with an effective date and also mentioned my intention to return the assets as necessary.

After 3 weeks, the company responded, stating they cannot accept my resignation without a 3-month notice period. They also requested the prompt return of the assets, warning that failure to do so would result in being labeled as an absconder. Please advise me on how to proceed.

Notice Period and Company Assets

You have to serve the notice period that you agreed to while accepting the employment. If you serve the notice period, then you cannot be labeled as an absconder. Provide a clear reply indicating your notice period and your date of relieving in accordance with that, or offer to buy out the remaining notice period after the proposed last day of service.

You have no right to retain the company assets, particularly when they are requested. There can be legal proceedings against you for defaulting in returning company assets.
