Accidentally Missed ESIC Enrollment: How to Handle Arrears and Avoid Notices?

neha-joshi1
Respected seniors,

Last month, I accidentally generated the UAN number of an employee. I came to know this month that although I have generated his UAN number, I didn't enroll him for ESIC (as his gross is below 21k). His actual joining date was 6th July 2021, and I have now enrolled him for ESIC on 19th August 2021.

Please advise on the steps to prevent any notice from the ESIC office and how to settle his arrears.

Steps to Rectify ESIC Non-Payment Issue

To address the situation where an employee's ESIC contribution was not drawn despite having the UAN generated, follow these practical steps to rectify the non-payment and prevent any potential notices from the ESIC office:

- Review the ESIC Contribution Threshold 📶
- Ensure that the employee's gross salary is indeed below the ESIC contribution threshold of 21,000 INR per month. If this is confirmed, proceed with the following steps.

- Calculate Arrears 💢
- Calculate the arrears for the period from the employee's joining date on 6 July 2021 until the current date. This will include the employee's and employer's contributions along with any applicable penalties.

- Generate ESIC Challan 🎁
- Access the ESIC portal and generate the challan for the arrears. Make sure to include all the necessary details accurately to avoid discrepancies.

- Timely Payment ⏰
- Submit the ESIC arrears payment within the stipulated time to avoid any further penalties or legal consequences.

- Update ESIC Records 📃
- After making the payment, ensure that the employee's ESIC record is updated with the correct contribution details to reflect compliance.

- Maintain Documentation 📝
- Keep records of the arrears payment, challan generation, and any communication with the ESIC office for future reference and audit purposes.

Additional Tips:
- Communicate transparently with the employee regarding the situation and the steps taken to rectify it.
- Regularly monitor ESIC compliance to avoid similar issues in the future.
- Seek guidance from a legal expert or consultant if needed to ensure full compliance with labor laws.

By following these steps diligently, you can rectify the ESIC non-payment issue, settle the arrears, and demonstrate proactive compliance with ESIC regulations.
