Legal Job Security for Staff and Faculty in Private Colleges

Is there any legal job security for staff and faculty in private colleges offering professional courses? There are more than 25,000 establishments in India, and employees in these institutions often feel they are at risk of being fired at any moment. Is there any legislation in place to protect their job security?

Job Security for Faculty in Private Colleges

There is no legislation affording job security or protection to faculty in private colleges and universities. The only protection available is related to the notice period. There is no central legislation providing any protection; however, some states have established rules regarding service conditions. The University Grants Commission (UGC) also has some guidelines, but their enforceability is questionable.

Legal Framework for Employment in Private Educational Institutions

Most states have their own laws for regulating the employment of teaching faculty in private educational institutions. The poster may check with the State Government website.

Non-Teaching Faculty Regulations

Regarding non-teaching faculty, the Industrial Disputes Act of 1947 is applicable. It was declared long ago by the Supreme Court that education is an industry, whereas a teacher is not considered a workman.
