Maternity leave during probation - Will maternity leave be considered as a part of training period?

Hi... I am working in the central government and took my maternity leave during my probation period. Will maternity leave be considered as a part of the training period or should I do the remaining probation? Maternity leave of few has been considered as a part of training and I don't know on what grounds it has been granted. Your answers will be highly helpful.

As Government employees, you are governed by the Maternity Rules of Government. This has to be examined from that provision. As regards Maternity Benefit Act, 1961 there is no provision to convert maternity leave into training. In fact if this done it will be violation of the Act itself.

I understand your matter very well. As you are in training period but if you are employee and getting salary not stipend and working at-least 80 days and above then you are eligible for the maternity leave as per maternity act.
If you are not cover under ESIC act then you need to approach your management team to get benefit and if you are cover under ESIC act then you can proceed to submit form 21.
