Maternity Leave During Probation: Do I Need to Extend My Training Period?

I am working in the central government and took my maternity leave during my probation period. Will maternity leave be considered as a part of the training period, or should I complete the remaining probation? Maternity leave for some has been considered as part of training, and I don't know on what grounds it has been granted. Your answers will be highly helpful.

Maternity Leave and Training Period for Government Employees

As government employees, you are governed by the Maternity Rules of the government. This needs to be examined from that provision. Regarding the Maternity Benefit Act, 1961, there is no provision to convert maternity leave into training. In fact, if this is done, it will be a violation of the Act itself.

I understand your situation very well. If you are in the training period but are an employee receiving a salary (not a stipend) and working at least 80 days or more, then you are eligible for maternity leave as per the Maternity Act. If you are not covered under the ESIC Act, you need to approach your management team to avail of the benefits. If you are covered under the ESIC Act, you can proceed to submit Form 21.
