Request for Assistance in Obtaining Due Gratuity from Employer

Dear Labour Commissioner,

I am writing to seek your intervention in the matter of obtaining my due gratuity from my employer. Despite my repeated requests, the employer has been delaying the payment, citing vague reasons for the delay.

I have completed all necessary procedures and fulfilled all obligations as per the company's policy regarding gratuity. However, the employer's reluctance to release the payment in a timely manner is causing undue financial strain on me.

I kindly request your office to investigate this matter and ensure that the employer complies with the relevant labor laws by releasing the due gratuity without further delay.

Thank you for your attention to this urgent issue.

Sincerely,

Dear Gopal, you cannot simply write a letter to the Labor Commissioner or another officer under his control for non-payment of statutory gratuity payable to you by the employer upon the termination of your employment.

Procedure for Claiming Gratuity

There is a procedure prescribed under the Payment of Gratuity Act 1972. The employee has to file a claim before the Controlling Authority appointed under the Act for the area where you worked last. It is a quasi-judicial proceeding. It is better to engage the services of an advocate for assistance, including filing a claim and conducting the case on your behalf.
