The transition of employee service from Company A to Company B has to be a detailed exercise involving clarity on the following aspects:
Is the post and pay protected in the process?
1. Is the seniority and past service protected? Is there continuity of service?
2. Has the past service of all employees being transferred to the new company, like leave salary, gratuity, and past service counted in the previous company, been counted for promotion purposes? Will gratuity be paid from the start of service in Company A?
3. Does the transition affect the future career prospects of the employees being transferred?
4. Are both the units in the same locality? If they are differently located, then reasonable time for joining, transfer leave for preparation, and some transfer grant to take care of charges for moving household goods and other items like vehicle(s) are to be provided.
5. Are the employees concerned voluntarily agreeing to such transfer? What happens to those not interested?
