Confused About Standing Orders for 80 Workmen? Should We Stick with Certified or Switch to Model?

As per the Labour Code 2019, the Standing Order is applicable to the manufacturing industry if the number of workmen is 100 or more. If it is less than 100, then the Model S.O. is applicable. However, in our industry, the number of workmen is 80, and we are currently following the Certified S.O.

Can any of our esteemed readers please clarify whether we should follow the Model S.O. or continue to follow the Certified S.O.?

Applicability of Standing Orders in Different States

As per the prevailing laws, in some states, the number of workmen shall be 100 or more for the applicability of Standing Orders. However, in states like Kerala, the number of workmen shall be 50 or more. Since you are in the state of Karnataka, please refer to the Karnataka Industrial Employment (Standing Orders) Act & Rules, 1961, for determining the applicability of CSO.

Certification of Standing Orders

If you have already obtained Certification of Standing Orders from the labor authorities, a photocopy of the same may be displayed on the Notice Board of the factory, and you are not required to follow the Model Standing Orders.

Changes in the New Labour Code

As per the new Labour Code, the number of workmen required for determining the applicability of Standing Orders has been increased to 300.
