Legally in Maharashtra, what should be the period of leave applicable for the Covid-19 affected employee? Please suggest.

I don't think there is no legally mandated leave period for Covid-19. The period of absence of the employee due to Covid may be treated as sick leave, and for sick leave beyond three days, the employee has to produce evidence in support, i.e., a medical certificate. The same may be followed for Covid employees - a medical certificate of fitness to resume work and a negative RT-PCR report may be insisted upon for the employee reporting to work. The number of days Covid disease lasts in a person varies from person to person.

As per the guidelines issued by the Maharashtra Government, a 17-day quarantine period is prescribed for people testing positive for COVID-19. Previously, this period was 14 days. Although the government has not mandated giving leave to employees during the quarantine period, there are very few organizations that have decided to provide COVID-19 special leave to their employees, either at full pay or 50% pay for the quarantine period. Some others have chosen to adjust it against the sick leave of the employee.

Dear Madam,

It is up to you to grant special Covid leave for the prescribed quarantine period or adjust the absence against his sick/privilege leave. There is no mandate to treat it as special leave over and above his current leave entitlement.
