Are Shops and Establishment Rules the Same for LLPs? Seeking Clarity on Notice Periods

Divya1995
Hi Everyone, I hope you are all well at your homes.

Applicability of Shops and Establishment Rules to LLP Organizations

Please help me with this: Are all the shops and establishment rules also applicable to LLP organizations? For example, should a 1-month notice period be given if an employee has been in service for the past 3 months? Is this applicable to LLP organizations?

Your assistance would be greatly appreciated.

Thanks!

Dear Divya, the applicability of statutory compliance and employment laws is defined based on the criteria mentioned in the respective acts. This has nothing to do with LLP.

Understanding LLP

The "LLP" term defines the legal registration of the organization. In other words, it is a "TYPE OF BUSINESS ENTITY" or, in general terms, the "Legal Ownership Status" of the organization.

Applicability of the S&E Act

The S&E Act is universally applicable to all organizations within the state jurisdiction that fall under the eligibility criteria (number of employees). It can be LLP, Partnership, Sole Proprietorship, Pvt Ltd, Ltd, Public Ltd, etc.

Hope this will clarify your doubt. Senior members can provide more input.

The applicability of all rules of the act may or may not be applicable as per the preconditions of the statute under the shops and establishment.

The Shop and Establishment (S&E) Act

The Shop and Establishment (S&E) Act is applicable to all commercial establishments. It shall apply to shops and establishments employing ten or more individuals, including business centers, offices, warehouses, stores, hotels, eateries, amusement parks, theatres, etc., nationwide. These establishments may be of proprietary, partnership, company, and LLP.
