Understanding EL/PL Eligibility in Coal Mines: Do You Need 240 Days Every Year or Just the First?

Dear All,

Please clarify regarding EL/PL eligibility criteria in coal mines.

- Is it necessary to accumulate 240 working days every year, or is it only applicable for the first year to meet the EL/PL criteria?
- For example, if a candidate meets the 240-day criteria in the first year, they are eligible for EL/PL as per the law. However, if in subsequent years, the candidate does not fulfill the 240-day criteria, are they still eligible for EL/PL on a pro-rata basis, or are they not eligible at all?

I kindly request all my seniors and colleagues to shed light on all the details about EL/PL.

Eligibility Criteria for Earned Leave (EL)

For every year, 240 days of attendance are a must for eligibility for Earned Leave (EL). If a worker has not attended 240 days, they are not eligible for EL for that particular year.

Qualifying Criteria for EL

There is a concept called qualifying criteria, which means a person's attendance in a year includes festival holidays and leave earned in the previous year for EL eligibility, which must be 240 days.

Calculation of Earned Leave

EL is calculated and will be given (excluding festival holidays and leave availed and calculated) at the rate of one day for every 20 days of attendance. If a worker does not comply with the above criteria, they lose their EL eligibility for that particular year.

Eligibility Criteria for Earning EL

240 days of continuous service every year is the enabling criterion for an employee to earn EL for the year. If it falls short, including the deemed days of presence explained above by Mr. Kumar, the employee will not earn any EL for that particular year in its entirety.
