Waiting for Final Payment After Resignation: Can I Take Legal Action Against My Former Employer?

sam-rosario
Hi Team, I resigned properly from my company in India, giving one month's notice period as per the contract. I have received my relieving letter but have not received my full and final payment dues. It's been almost 3 months, and I have not received anything. I have sent several reminders to my HR, but they have cited the pandemic as the reason, stating that due to COVID, the company is in a tight financial situation.

Options for Pursuing Unpaid Dues

My question is, what options do I have? Can I pursue this matter legally?

Yes, Sam, sometimes legal action for the recovery of dues from an employer becomes inevitable. However, you can be considerate to some extent if the reasons for the delay are genuine and justifiable.
