Confusion between ESIC & WCA, for corporate and non-corporate area

cgm
Our company is situated in a Non-corporate area, and all employees have been covered under WCA Insurance Policy. But, the Registered office of the company is located in the city (corporate) area. So the question is that the office staff workers come under which act, the ESIC act or WCA?

Irrespective of area, all employees has to covered either ESIC Act or WC Act (now Employees compensation act). ESIC Act will be applicable only in a notified area where the Local office and hospitals are available as per the Act. But where there is no applicability of ESIC Act, WC Act will be applicable with out doubts. Hence, in any one of the compensation act will be applicable, you need to cover your employees as per Act.

The employees of your company shall not be covered under ESI, provided area is situated out of ESI notified area. The ESI is different than of WCA Insurance Policy, so the comparison is out of subject. The WC policy is applicable to both the establishment.
The ESI is applicable to the employee of the Registered office if the area declared under ESI may be a City or Village.
