Can a Temporary Construction Worker Get Retrenchment Pay After Resigning? Seeking Advice from Seniors

A casual/temporary employee has worked for 4 years in the construction industry and now he wants to resign. If he submits a resignation (immediate leaving from the job), will retrenchment compensation benefits be paid to him or not? Request to Senior, please suggest.

Retrenchment Compensation for Resigning Employees

Whether he is a permanent employee or a temporary employee, there is no question of retrenchment compensation arising. Since he has resigned, his dues may be settled after adjusting for a one-month notice period if he wants to be relieved immediately.

Please note that retrenchment refers to the cessation of work by an employer under the Industrial Disputes Act, where the compensation will be according to the law, which does not apply in this case.
