Notice Pay Deduction in less than 6 months job offered - if the employee did not serve the notice period

Can we deduct the notice pay amount according to terms of employment or labor law if the employee did not serve the notice period and we are offering him a job less than 06 months tenure in a registered organization?

It would depend on the terms of employment of the employee and the Labour Laws applicable upon your industry. Please elaborate.

The terms and conditions of appointment is binding for both Employee & Employer. The employee has to serve notice period or to pay equivalent sum. Where, employer wants to release the employee on early date, requires to pay the notice pay amount.
