Employee Claims Past PF Membership After 7 Months – How Should We Handle This?

Employee's PF and ESI Issue

An employee joined the firm and was given ESI. He filled out PF Form 11, stating he did not have any past PF. As his salary of ₹18,000 was above the PF bracket, the firm only provided him with ESIC benefits. Now, after 7 months of work, the employee is demanding PF and claiming that he was a past PF member, presenting old PF records from his previous firm.

Welfare Contributions for Employees

Welfare contributions are to be offered to all employees on a uniform basis. It does not matter if the basic salary of any employee is more than ₹15,000; they are considered an "excluded employee" unless they provide written notice that they are not a member of PF and do not wish to join.

Disciplinary Action for False Information

One more note: The employer has the option to take disciplinary action against an employee for providing false information, as stated in Form 11.
