Seeking Guidance on ESIC and EPFO Pension and Artificial Limb After Severe Accident

Hi, I am Jitendra from Rajasthan. I was working with Vodafone as a Store CCE. I met an accident while coming home from the office in a transport roadways bus on 16 Nov 2019 (the bus crashed with a truck). I lost my right leg from the knee down with a big fracture in the femur of the same leg. I also suffered a fracture in my right jawbone, and my right eye was punctured with glass. Additionally, my right hand was imbalanced or crushed from the wrist part.

I underwent ten critical operations after the accident, with the last procedure taking place in Oct 2020.

I had been working with Vodafone on the payroll of Ikaya for the last continuous 5 years. I was receiving a salary of 17,839 rupees plus a 7,000 rupee (15% variable parts 200%) incentive, totaling almost 25,000 rupees.

I was connected with ESIC and EPFO.

Now, I am feeling better health-wise and would like to know:

1. How much and how can I get a pension from ESIC and EPFO?

2. What is the process to obtain an artificial limb through ESIC?

Please advise me.

Compensation for Permanent Partial Disablement

You are eligible to receive compensation for permanent partial disablement in accordance with the ESI Act 1948. The compensation would be payable every month and would depend on the loss of earning capacity.

Pension Eligibility in the PF Scheme

Regarding pension in the PF Scheme, eligibility exists only in cases of permanent total disablement while in service, and if you have been terminated and are jobless. You will need to apply at both the local offices of PF and ESI and contact both of them.

Thank you, sir. Actually, I have completed all the documentation required by ESIC for a pension, specifically for being eligible for disablement while working. Here are the details:

1. Daily commuting from home to the office has been documented on my employer Vodafone's letterhead.
2. I have provided paper cuttings, a police FIR, and a doctor's report.
3. A declaration has been submitted by me and all my colleagues confirming my daily commute from my village home to the office.

Now, the SRO has assured me that it will be processed. I have a few questions:

1. Could you please inform me how much it will amount to, and will it increase as my salary increases annually?
2. How can I obtain rehabilitation (an artificial limb) through ESIC? What is the procedure?
3. Do I need to follow the same process for EPFO pension as for ESIC? Can you provide more details?

Your elaboration on these matters would be greatly appreciated. I have been unable to walk for the past year.

ESIC and Medical Supervision

As mentioned, the member was a regular contributor to ESIC. Therefore, it is assumed that total medical supervision was completed under ESIC. ESIC is not applicable above an average wage of 21,000/-. So, be careful during discussions and consider only your actual ESIC salary, which is around 18k.

Disability Benefits and Artificial Limb

ESIC AMO may call a medical board for the fixation of disability benefits on an ad-hoc and per month basis (it is not a pension). Regarding the artificial limb, the AMO in your jurisdiction may call a medical board and recommend further action.

EPF and Pension Details

Regarding EPF, the amount contributed towards your EPS is not available. However, as the service period is only 5 years, it may be fixed at the lowest, i.e., 1000 (the lowest minimum pension at present), subject to the new pension bill for enhancement, which is pending in LS for pension enhancement.
