Gratuity Payment for Permanent International Transfers that have not completed 5 years of service in India.

Respected members,
I worked at an MNC in India for 4 years and then took a permanent international transfer outside India. The Indian based entity has paid my full and final settlement but did not pay my gratuity. I am still employed by the same organisation outside India but I would like to understand if I can claim my gratuity for my service period in India as I just missed it for a few months... :(
Appreciate any help from experts.

It has to be examined as to the terms of your international transfer of services, whether it was assuring continuity of service or there is a break in service? If you have completed 4 years and eight months (read 240 days of continuous service in the fifth year of service) you would be eligible to get gratuity. Pl check the factual position and then revert to us.
