Dear Sir/Madam, I need help regarding my resignation.

Service Contract and Legal Implications

In my offer letter, there is a 2-year service contract mentioned. If this contract is breached by the employee, they are required to pay a certain amount. Is this legal?

Current Employment Situation

I have completed 1 year and 3 months in the company, but the company started deducting 15% of my salary from April 1st, and there have been no appraisals due to COVID. Therefore, I do not wish to continue working here, especially considering the possibility of being sent on-site, which I do not desire. Consequently, I submitted my resignation last month and am currently serving the 60-day legal notice period.

Experience Letter and Confirmation Issues

Now, the company is requesting me to pay a certain amount for the experience letter. The company has not provided me with a confirmation letter via email or physical copy even after numerous follow-ups, both through emails and verbally. However, post my resignation, they sent a confirmation email and uploaded the confirmation letter on the company portal with a previous date.

Company's Demands and Next Steps

The company is demanding that I complete 2 years with the same salary and conditions, or else I will be required to pay a certain amount. What actions can I take? Please assist me.

As you had unconditionally accepted the service agreement providing for payment of compensation in case you terminate the service before the end of two years, you are bound by it.

As you have served them for nearly 1.5 years, you can seek a proportionate reduction in the bond amount.
