Legal agreement draft regarding Advance payment to employee and that they should repay the amount within 6 months

Hello, I am working as an HR professional in a pharmaceutical company. I am in need of a legal agreement letter template for drafting an agreement regarding the payment of advance salary to an employee. The agreement should outline that the employee is required to repay the advanced amount within 6 months in equal installments deducted from their salary. Additionally, it should specify that the employee cannot resign from their position before repaying the full amount. Thank you.

You need not make it a purely legal agreement. Add one line in the salary advance application form itself stating that, "I hereby agree to repay the amount of the salary advance of Rs ....../- (Rupees -------) and authorize the company to deduct the same from my salary in six equated monthly installments starting from the salary payable for the next month."

It is not right to state that the employee cannot leave the job in the meanwhile. However, you can add a clause that, "In the event of my leaving the services of the company before the recovery of the advance is completed, I authorize the company to deduct the remaining amount along with --% interest on the salary advance amount from my full and final settlement amount."
