Is It Fair for Our Retail Company to Cut Salaries to 20 Days Post-COVID in India?

Hello all, ours is a retail company where we are not receiving a full month's salary after COVID-19; now we are only eligible for 20 days' salary. Are there any rights for the company to do this?

In India, the non-payment or reduction of an employee's salary without proper justification is a violation of labor laws. Here are the steps you can take to address this situation:

Check Employment Contract and Company Policies
- Review your employment contract and company policies to understand the terms related to salary payments, deductions, and any provisions for exceptional circumstances like COVID-19.

Communicate with HR or Management
- Approach your HR department or management to seek clarification on why only 20 days' salary is being paid. Request a detailed explanation for the deduction and inquire about the legal basis for such action.

Refer to Applicable Labor Laws
- Refer to the Payment of Wages Act, 1936, which mandates timely and full payment of wages to employees without any unauthorized deductions. If the company is not complying with this law, you may have grounds for legal action.

Consult a Legal Professional
- If the issue remains unresolved or if you believe your rights are being violated, consider seeking advice from a labor law attorney or legal advisor to understand your options and the best course of action to take.

File a Complaint
- If all internal avenues fail to address the salary deduction issue, you can consider filing a formal complaint with the labor department or the appropriate labor authority in Mangalore to investigate the matter further.

Remember, it's essential to approach this situation professionally and follow the proper channels to ensure your rights as an employee are protected.
