Can we mention in leave policy that employee has to utilise his EL first and then only emergency leave? Is it legally right?

We are a Mumbai based IT company also running BPO and KPO comes under Bombay Shop and establishments
We have a total of 21 leave ..EL 13 and emergency leave 8(2per quarter).
Can emergency leave called as CL. Can we mention in the leave policy that an employee has to utilize his EL first and then the only emergency leave? Is it legally right?
(We are in operation so we don't want to encourage employees to take unnecessary leave)
Any new employees before six months can't get EL so he has to take emergency leave
If I am sick for three days in this case these leaves will b deducted from EL?
Any leave more than one is EL? All planned leave is EL if it is 1 or more than 1? Any unplanned leave is Emergency
