Can My Employer Withhold My Salary During the Notice Period? What Should I Do If They Don't Pay?

I am currently on my notice period until 11th Nov 2020 but haven't received a salary for Oct 2020. Can they withhold my salary for this month even though I have been regular but on notice period since 11th Sep 2020? Please suggest what I can do if they don't pay me.

You are eligible to receive your monthly salary during the notice period, provided you attend all working days of the establishment.

Usually, whenever an employee resigns, the company withholds the employee's salary during the notice period and pays it during the Full and Final settlement. This is done to ensure that the concerned employee has no dues payable to the company and that the employee is properly handing over their responsibilities before official relieving.

It seems you have a 2-month notice period. Therefore, you have not received your salary for October 2020. I suggest you have a friendly dialogue with your HR about the salary withholding and also to understand the exit policy.

Many times, it depends on the organization and management, but legally, yes, you are eligible to receive your monthly salary during the notice period. They can only withhold your salary if you exit without serving your notice period.
