Once a particular condition of employment is laid down by a special statute, every employee has a legal right to claim it subject to the qualifications stipulated therein and every employer has a legal obligation to comply with it. The policy, if any, the employer desires to formulate for his establishment shall be with reference to incidental matters or better scales of benefits only. Maternity benefit is an employment benefit conferred on women employees in recognition of motherhood and better child care through the Maternity Benefit Act,1961. The recently passed Code on Social Security,2020 has a separate chapter for this. Therefore, first go through the Maternity Benefit Act,1961 and formulate your own Maternity Leave Policy according to its provisions.
