Confused About EPS Withdrawal: How Can I Claim the Full Amount for My 7.9 Years of Service?

sarath-sics
I have a total of 7.9 years of service under PF. In my first company, I worked for 2.10 years and in the last company for 4.11 years. I transferred my PF from the first company to the second company. The PF of the second company is managed by their trust. After completing my service, I applied for EPF and EPS withdrawal through my company. I received the EPF amount after TDS deduction. The reason given was that my service duration under the company is less than 5 years, although my total service is 7.9 years. I am unsure if the TDS deduction was correct or not.

My main concern is regarding EPS

According to my calculations, I should receive an EPS withdrawal amount calculated as 8.22 * 15000 (for 7.9 years of service). However, they calculated based on the last company only, which is 5.02 * 15000. Upon checking the EPF site, I found details of both companies in the service history along with the EPS starting date for each. However, in the online claim, only the service details of the last company are shown, resulting in the EPF starting date being considered from when I joined the last company. How can I receive the remaining EPS amount? Please assist me.

In the situation described, it appears there are discrepancies in the calculation and disbursement of your EPF and EPS amounts. Here's a practical guide to address your concerns and seek resolution:

1. Review EPF and EPS Calculation:
- Verify the EPF and EPS calculations provided by your company against the actual service duration in both companies. Ensure the calculations are accurate based on your complete service history.

2. Check EPS Transfer Details:
- Confirm if the EPS transfer from your first company to the second company was processed correctly. Ensure that your EPS service history reflects all your years of service accurately.

3. Contact EPF Authorities:
- Reach out to the EPF authorities or visit the nearest EPF office to discuss the discrepancy in EPS calculation. Provide them with all relevant documents, including details of your service history in both companies.

4. Submit a Formal Complaint:
- If the issue persists, consider submitting a formal complaint to the EPF office outlining the specific problem regarding the EPS calculation and withdrawal. Include all supporting documents to strengthen your case.

5. Seek Clarification from HR:
- Engage with your HR department to understand the reasons behind the TDS deduction and the EPS calculation based on the last company only. Request a detailed explanation and clarification on the process followed.

6. Follow Up Regularly:
- Stay proactive and follow up regularly with both your company's HR department and the EPF authorities to track the progress of your case. Persistence is key in resolving such discrepancies.

7. Legal Recourse:
- If all attempts to resolve the issue amicably fail, consider seeking legal advice from a labor law expert in India. They can guide you on the next steps to take, including any legal recourse available to you.

By following these steps and actively engaging with the relevant authorities, you can work towards obtaining the correct EPS amount based on your total service duration. It's essential to ensure that your EPF and EPS withdrawals are processed accurately to safeguard your financial interests.
