How Does the New ESI Act Extension Affect Your Business with 10+ Employees?

Dear All, please find attached a draft notification from the Government of Maharashtra fixing the date as 01.10.2020 to extend the ESI Act. This extension applies to establishments where 10 or more persons are employed, including Shops, Hotels, Restaurants, Road Motor Transport Establishments, Cinemas (including preview theatres), and Newspaper Establishments.

Dear All, Effective from October 1, 2020, onwards in Maharashtra, the ESI Act is applicable to shops, hotels, restaurants, road motor transport establishments, cinemas including preview theatres, and newspaper establishments employing 10 or more persons.

Please find attached herewith a notification in this regard dated 10.09.2020, which should now be read as a Notification and not as a Draft Notification, as per the Corrigendum vide Notification dated 29.09.2020.

Dear Akhil Sir, I have one doubt. Is it applicable to 10 employees or 10 ESIC eligible employees (gross salary up to Rs. 21,000)? Thank you.

Dear Shivkumargarg, you are requested to read the notification dated 30.09.2020, wherein it is mentioned that "wherein 10 or more persons are employed...". You need to take headcounts for the coverage of your establishment and not coverable employees.
