EPF Contribution During Maternity Leave

I have a question regarding the EPF contribution from the employer during maternity leave. I saw the discussion but still have a small doubt.

My wife's EPF account is showing blank, which means no contribution happened between April 2019 to October 2019. She later rejoined on November 5th, 2019, and worked for some days before resigning.

From January 2020 till date, I've been trying to get a full settlement of EPF but have not been able to. I have called the respective HR several times, but there is still no solution.

While trying to get the amount, it's showing the message "April to October no contribution. Contact Employer."

Please provide your response so that I can resolve this.

If during the maternity leave period you received a salary (assuming that you were not under ESI), contributions to PF should have been deducted and paid. Non-payment of contributions is a non-compliance on the part of the employer, for which you, as a member of PF, cannot be denied your claim. If they had not paid a salary during your maternity period, they should have shown these days as non-contributory. In that case, the system would still accept your claim.

Therefore, the only remedy available is to ask the employer to pay contributions or file a petition before the Assistant Provident Fund Commissioner, narrating the issue and seeking intervention. If you proceed like this, the EPFO will direct the employer to remit the PF contributions omitted with interest and damages as per separate notices and settle the claim.
