Feeling Pressured to Return to Office During COVID: Can I Take Legal Action Against My Boss?

Hi, I work in third-party payroll and handle client training requirements. Recently, my boss has been pressuring me to return to the office. Due to the COVID-19 situation, I am currently in my hometown. I have shared my current challenges, possible solutions, and also mentioned that I am looking for a good paying guest accommodation. I plan to return as soon as possible.

While working from home, I have diligently fulfilled all my responsibilities and commitments 100%.

Now, my boss is trying to convince his superiors that my absence from the office is intentional. Additionally, he has been creating unnecessary issues, such as pointing out the use of a Gmail ID in professional emails, suggesting a setup for entrapment, and hinting at the possibility of receiving a notice or termination letter. Can I take legal action against my employer? Kindly advise.

Dear friend, the option of WFH is not to be exercised by the employee at will. Although some of you are permitted, for convenience or due to ill health, to WFH even before the COVID pandemic, it does not give you an automatic discretion to choose between WFH or returning to the base. Many individuals like you are increasingly returning to the base, even though some establishments wish to continue due to the inherent advantages. In your case, since you are already required to report to the base, defying this would be treated as insubordination and indiscipline. You will have no defensible option to remain at home. Reconciling with the situation is expected of a prudent employee. By strictly observing precautionary SOPs on managing the pandemic, one can safely attend the office. I suggest not being adamant about this, seek pardon, and return to the office, as noted by your bosses, to avoid harming your assessment. Remember, the Boss is always right.
