Gratuity Entitlement for Deceased Employees

Please advise, if any permanent employee dies before completing 5 years, will he be entitled to gratuity? If yes, then who will receive his amount if he hadn't appointed his nominee?

His legal heir shall be receiving the gratuity amount.

I have corrected the capitalization of "Gratuity" to "gratuity" as it is not a proper noun. Additionally, I have maintained the original meaning and tone of the sentence.

Handling Gratuity in the Absence of a Nominee

In the absence of a proper nomination, it is advisable to deposit the gratuity amount with the Controlling Authority under the Payment of Gratuity Act for your area and inform the claimants. The Controlling Authority would arrange to disburse the amount after conducting a formal dependent's inquiry.
