Can a Principal Employer Claim PMRPY Benefits from a Direct Employer on Call Basis Contracts?

One PSU has demanded passing on the benefits availed under PMRPY as the principal employer on a call basis contract. Does this scheme have provisions for such a claim by the principal employer from the direct employer? Please advise.

The Pradhan Mantri Rojgar Protsahan Yojana (PMRPY) Plan Scheme has been designed to incentivize employers for the generation of new employment. Under this scheme, the Government of India will pay the full employer's contribution towards EPF & EPS both, effective from 01.04.2018 (earlier, the benefit was applicable only for the employer's contribution towards EPS) for new employment. This scheme has a dual benefit. On one hand, the employer is incentivized to increase the employment base of workers in the establishment, and on the other hand, a large number of workers will find jobs in such establishments.

Ethical Considerations for Principal Employers

The principal employer trying to garner the benefit given to the immediate employer is improper and unethical, as the scheme is intended to benefit the direct employer to add manpower.
