How Can Employers Seek Exemption from ESIC if Their Benefits Are Better?

In the above link under Rights of Employer, there is a point that states:

- Right to seek exemption from the applicability of the Scheme in case benefits provided by the management are similar or superior to those available under the ESI Scheme.

If there is a provision related to this, kindly let me know the procedure for availing exemption.

This exemption from the applicability of the Scheme is granted if you are providing benefits to your employees similar or superior to those available under the ESI Scheme in all respects. The exemption granted has to be extended periodically, I think every year, by making an application.

It is not easy to get this exemption. You cannot grant all benefits at par with benefits under ESIC in all respects. To my knowledge, or it was told to me, only TATA has this exemption at Jamshedpur.
