Confused About ESIC Rules? Do I Need to Register if One Employee Earns Under 21,000?

Hello Friends, I was under the impression that if the total employee strength crosses 10/20, then ESIC is applicable if even one employee's salary is below 21,000/-. Now, at the time of reading the ACT, I am a bit confused since the proviso to sec 2(9) says an employee does not include any person so employed whose wages (excluding remuneration for overtime work) exceed [such wages as may be prescribed by the Central Government].

So, does it mean that if the employee is earning less than 21,000/- and I cross the 10/20 employees limit, then I am liable to register? Kindly explain whether I am interpreting this right or wrong.

Yes, it is the statutory responsibility of the employer under Section 2A of the Act, read with Regulation 10-B, to register their Factory/Establishment under the ESI Act within 15 days from the date of its applicability to them.
