Unpaid Leave Without Notice: How Can We Address This Sudden Job Insecurity?

Hi, I work for a small private limited company based in Noida and registered under MSME. The company is operated under single-handed ownership. On April 10, 2020, the HR manager informed us suddenly that the management has decided to place all or some non-sales employees on unpaid leave with immediate effect. Despite repeated requests, we have not received any letter or email regarding this matter.

It has now been more than three months since we have received any remuneration or salaries. We were only paid for 22 days in March. The HR managers have been providing us with false assurances that we will be reinstated once the situation returns to normal.

Additionally, HR is pressuring us to return assets such as laptops, SIM cards, etc. Our official IDs and WhatsApp groups have been blocked and changed without any prior notice by the IT department.

Kindly advise on the appropriate steps to take next. Can a complaint be filed? If so, what is the best course of action? Please help!

Nikunj, please reach out to your local Labour Union office to provide details of the matter and seek immediate resolution. It has been a tough time for everyone; however, considerate management will never resort to measures like culling headcount without cause, withholding salaries and expenses, or forcing LWPs. These actions are all illegal as stipulated by the Government of India in various rulings and Acts.
