Is It Legal for Companies to Demand Assets Back During Unpaid Compensatory Leave?

Hi,

My company is giving compensatory leave without pay for two months but employees are required to submit all company assets such as laptops, ID cards, and everything else. Is this practice legal?

No, has this employer taken such a step whenever employees proceed on leave without pay? Beware of such pernicious move.

Hi KS,

I may add, I couldn't imagine any "compensatory leave" for "2 months". How is this being administered? Can you please explain the circumstances/background for me to understand better?

No, they are giving this letter this time only and stating the reason for COVID. Even HR is just sending the letter to our email id, with no communication with the employee.

In that letter, they are mentioning the reason for COVID-19. They are requesting to submit company assets like laptops, etc., and mentioning that they are reducing staff on a temporary basis. They will re-evaluate the continuation of CLWP time to time, and the same shall be communicated to you in advance.

Hi Sonia,

This compensatory leave of 2 months can be decoded as follows - it's a complete eyewash as they proceed with layoffs of employees on the grounds of COVID-19. It is not possible that the company gives compensatory leaves of "2 months" on one hand and on the other takes back employee assets like laptops, ID cards, etc.

The ideal way of justifying a reduction in cost could have been giving a few unpaid days off and/or making some deductions in salary while still allowing employees to work from home.

Good luck to you!

What would happen if you don't hand over these assets as specified by them? Why do you have an apprehension that they may not call you back? Is there any imminent downsizing of the workforce being floated in the office?
