Facing Salary Issues as a Remote Coding Instructor: Should I Seek Help from Labor Authorities?

Hi, I am working as an online coding instructor for a company based in Gurugram and Delhi. I work remotely from Hyderabad using their online platform to teach students. I have 20 hours per week as per our agreement. They sent me a contract agreement, offer letter, and two other documents. Till now, they have not paid me any salary, although my dashboard on their website, after login, shows the salary figure in the earnings section. They say that the parents have complained about me.

As such, they have decided to stop the payment. They said they will observe my performance for one week and then decide. So far, I have not taken any leave nor been absent for any classes. I have sent a letter regarding the non-payment to the manager, but he is not responding. Can somebody suggest what to do in this case? Should I approach the labor commission office of Gurugram or Hyderabad?

Hi,

Teachers do not fall within the ambit of the definition of 'workman,' hence they cannot approach the Labour Commission. Since the nature of the job is teaching, no protection is available in this case under the Industrial Disputes (ID) Act, which is available to a workman!

However, the case can be further proceeded with as per the contract agreement.
